Terms of use and sale

These terms govern the use of the Watch'n'Learn service — the watchnlearn.eu website, the web application and the iOS application ("the Service") — published by ABA-INSTITUT, a French SAS with share capital registered with the RCS (trade and companies register), SIREN 920 910 890, with its registered office at 47 route de la Grange aux Moines, 78460 Choisel, France ("the Publisher"). By creating an account, you accept them.

1. The Service

Watch'n'Learn offers series of video and audio language-learning exercises for children with a language delay and/or autism spectrum disorder, together with a teaching manual and per-child progress tracking. The Service is a teaching tool: it does not constitute medical advice and does not replace the support of a healthcare professional or therapist.

2. Account and free trial

Registration is open to adults (parents or professionals). You agree to provide a valid email address and to keep your login details confidential. A 14-day free trial, with no credit card required, gives access to all content in the chosen language.

Child profiles are created under the responsibility of the adult account holder, who confirms that they are the child's parent or have the necessary permission. Only a first name or nickname is accepted (see the Privacy policy).

3. Subscription, prices and payment

After the trial, full access requires a monthly or annual subscription. Current prices, including all taxes, are displayed on the Account page before any payment. Payment is processed by Stripe; no card data passes through our servers.

The subscription renews automatically at each billing date (monthly or annual). You can cancel at any time via "Manage subscription" on the Account page; cancellation takes effect at the end of the current, already-paid period, at no charge. In accordance with Article L.215-1 of the Code de la consommation (French Consumer Code), you may cancel electronically at any time.

The Publisher may change its prices; any change is communicated at least 30 days before the next billing date and applies only to subsequent renewals.

4. Right of withdrawal

You have 14 days from taking out a paid subscription to withdraw, without giving a reason, by writing to caroline@abainstitut.fr. If you asked for immediate access to the Service, the refund is calculated pro rata for the unused period. The free trial also lets you test the Service in full before any payment.

5. Licence to use

The subscription grants a personal, non-exclusive and non-transferable right to use the Service, for the needs of the account holder's household or professional practice. Sharing the account beyond that scope, or copying, extracting, redistributing or reselling the content (exercises, videos, images, sounds, manual), is prohibited; the content remains the exclusive property of the Publisher.

6. Availability

The Publisher works to keep the Service continuously available, including an offline mode once content has been downloaded, but cannot guarantee absolute availability (maintenance, incidents, networks). The Publisher is not liable for indirect damages; in any event, its liability is limited to the amounts paid over the last 12 months of subscription.

7. Personal data

How we process data is described in the Privacy policy, which forms an integral part of these terms.

8. Termination by the Publisher

In the event of a serious breach of these terms (large-scale account sharing, content extraction, fraud), the Publisher may suspend or terminate the account after a notice that has gone unheeded. Amounts paid for the current period are not refunded in cases of proven fraud.

9. Mediation and disputes

These terms are governed by French law; consumers residing in another European Union country keep the protection of the mandatory provisions of their national law. In the event of a dispute, please contact caroline@abainstitut.fr first. If no solution is found, consumers may refer the matter free of charge to the designated médiateur de la consommation (French consumer-mediation scheme): CM2C (membership in progress — this notice will be updated once finalised), or to the competent courts.

10. Changes

The Publisher may amend these terms; users are informed of substantial changes at least 30 days before they take effect. Continued use of the Service constitutes acceptance of the updated terms.
